This Refund Policy (“Policy”) forms part of the Ox2 Net Corp. Terms of Service. By subscribing to our services or purchasing any product from Ox2 Net Corp., you (“Client”, “Subscriber”, “You”) acknowledge that you have read, understood, and agreed to be bound by the terms set forth herein.

Ox2 Net Corp. (“we”, “us”, “our”) provides a limited 30-day money-back guarantee under strict conditions only for eligible hosting services. Software, plugins, and digital products are strictly non-refundable, as detailed in the applicable sections below.

Services Eligible for Refund

You may request a refund only for:

  • First-time purchases of Shared Hosting, WordPress Hosting, and WooCommerce Hosting plans
  • Purchases made directly through ox2net.ca or an authorized reseller
  • Orders paid via credit card or PayPal only

Refund requests must be submitted in writing to in**@*****ox.ca within 30 calendar days of the original purchase date (“Initial Term”).

Non-Refundable Services

The following products and services are strictly non-refundable under any circumstances:

  • Domain name registration, transfer, and renewal fees
  • SSL certificates
  • Custom plugin or software development
  • Proxmox VPS Hosting, Dedicated Servers, and Virtual Environments
  • Any service activated or used during the refund period
  • Setup fees, onboarding fees, or administrative service charges
  • Promotional or discounted plans
  • Upgrades, downgrades, or migration services
  • Cryptocurrency or international wire transfer payments
  • Add-ons, license keys, and third-party service integrations
  • Software, plugins, code modules, templates, and any digital product

In accordance with ICANN’s Transfer Policy and domain regulations under the Uniform Domain Name Dispute Resolution Policy (UDRP), domain services are considered fully rendered at the time of provisioning.

Strict No-Refund Policy for Software and Plugins

All software, plugins, and digital products sold through this website are governed by the following terms:

  • All code and software products are the exclusive intellectual property of Ox2 Net Corp., protected by Canadian and international copyright laws.
  • Upon purchase, you are granted a Lifetime Open Source License which provides:
    • Full access to the source code
    • No license key required for installation
    • The right to modify, customize, or adapt the code to your internal needs

However, the following applies:

  • You do not own the copyright or intellectual property.
  • You may not resell, redistribute, sublicense, or represent the code as your own.
  • Once modified, your version becomes a derivative copy, and you forfeit the right to receive updates, compatibility support, or guarantees of future interoperability.
  • No refunds are permitted for software under any conditions, including performance dissatisfaction, feature limitations, or post-purchase change of mind.

  • Canada: Business Practices and Consumer Protection Act (SBC 2004), Section 56
  • U.S.: Uniform Commercial Code § 2-316 and § 2-615 (Exclusion of Warranties for Custom Software)
  • Chile: Ley Nº 19.496, Art. 3 Bis Letra B
  • EU: Directive 2011/83/EU, Article 16 – Digital goods are exempt from withdrawal rights once download or access begins

Conditions of Refund Eligibility (Hosting Services Only)

To qualify for a refund on eligible hosting plans, you must:

  • Submit a written request within 30 days of the original purchase
  • Not exceed 20% of included server resources (bandwidth, CPU, or storage)
  • Not violate the Acceptable Use Policy or Terms of Service
  • Not initiate any chargebacks or payment disputes
  • Have no outstanding balances on your account
  • Be able to verify account ownership and personal identity

Failure to meet any of these conditions will void your eligibility for a refund.

Refund Method and Timeline

If approved, refunds will:

  • Be processed to the original payment method within 30 business days
  • Be issued only in Canadian Dollars (CAD)
  • Exclude administrative fees (typically 10% to 25% based on processor costs and currency conversion)
  • Be denied or reduced in case of exchange rate fluctuations, intermediary bank fees, or third-party delays

Ox2 Net Corp. is not responsible for financial losses due to foreign exchange, wire deductions, or third-party processor errors.

Abuse and Anti-Fraud Enforcement

We reserve the right to deny or revoke refunds for any client suspected of:

  • Creating multiple accounts to abuse refund policies
  • Engaging in fraudulent or suspicious activity
  • Violating server usage rules (e.g., spam, phishing, CPU abuse)
  • Exploiting system vulnerabilities

Clients found violating these policies may face:

  • Permanent service bans
  • Reporting to relevant authorities or financial institutions
  • Legal action under applicable fraud statutes, including:
    • Canada: Criminal Code § 380
    • United States: 18 U.S. Code § 1343 (Wire Fraud)
    • Chile: Código Penal, Artículos 467–470

Post-Refund Consequences

If a refund is granted:

  • All associated services will be immediately terminated
  • All files, emails, databases, and configurations will be permanently deleted
  • Domain names provided as part of a “Free Domain” promotion will be charged at full retail cost, which may be deducted from your refund
  • You will lose access to licensed software, updates, support, and backups

Disputes, Chargebacks & Reversals

You agree to first attempt resolution by contacting us at in**@*****ox.ca before initiating any dispute or chargeback.

Unauthorized chargebacks may result in:

  • Immediate account suspension
  • A minimum penalty of CAD $75.00, plus recovery and legal fees
  • Cross-border enforcement under international agreements, such as the Canada–U.S. Civil Enforcement Agreement

We reserve the right to retain all logs and data to defend against fraud and abuse.

Jurisdiction and Governing Law

This Refund Policy is governed by and interpreted under the laws of:

  • Canada: Business Practices and Consumer Protection Act (British Columbia)
  • United States: Uniform Commercial Code § 2-615 and Electronic Funds Transfer Act
  • Chile: Ley Nº 19.496 sobre Protección de los Derechos de los Consumidores

Clients outside these jurisdictions acknowledge that:

  • Ox2 Net Corp. is not bound by EU withdrawal rights, e-commerce directives, or consumer cooling-off periods.
    • Examples include:
      • EU Directive 2011/83/EU (Right of Withdrawal)
      • GDPR Art. 6.1(c) where no contractual performance is pending

Ox2 Net Corp. reserves the right to amend this Refund Policy at any time without prior notice. Continued use of our services and website implies your acceptance of the current and updated terms.
